ABOUT THE POSITION:

The Clark County District Attorney's Office invites you to apply for the position of Senior Attorney in our Civil Division. The Senior Attorney in this position will represent and advise the Clark County Department of Air Quality (DAQ) with a focus on the interpretation and enforcement of the federal Clean Air Act, NRS Chapter 445B and Clark County Air Quality Regulations. DAQ serves as the air pollution control agency for Clark County, Nevada ensuring that the region's air quality meets all local, state and federal standards. In addition, the Senior Attorney will work on contracts, other environmental legal issues, administrative proceedings, litigation, interpretation of federal, state and local laws applicable to DAQ operations, and drafting new DAQ rules and regulations.

This position will be used to fill vacancies in the Civil division of the District Attorney's Office.

This examination will establish an Open Competitive and Promotional list to fill current and/or future vacancies that may occur within the next six (6) months or may be extended as needed by the Office of Human Resources.

MINIMUM REQUIREMENTS

Education and Experience: Possession of a certificate of admission to the Bar of the State of Nevada and eligibility to practice law before the courts of the State of Nevada, AND eight (8) years of full-time experience in professional legal work related to the Clean Air Act and other environmental law, including four (4) years as a practicing attorney. If you do not currently hold a certificate of admission to the State of Nevada, you must hold a certificate of admission to the bar in another state and obtain a certificate of admission to the Bar of the State of Nevada within one (1) year from date of employment.

Background Investigation: Employment is contingent upon the results of a background investigation, which may include both a pre-and post-offer background check for positions within the District Attorney's Office.

Pre-Employment Drug Testing: Employment is contingent upon the results of a preemployment drug examination.

EXAMPLES OF DUTIES

Plan, direct, coordinate, and review work of subordinate staff in the preparation of cases for hearings and/or trial; assure appropriate handling of cases and the provision of quality professional legal services. Supervise new attorneys; provide for appropriate training of attorneys; assign cases; review cases and settlement offers; evaluate staff performance. Provide assistance and advice to other attorneys with regard to issues in specified areas of expertise.

In the District Attorney's Office, oversee cases and attorneys assigned to a team or unit; supervise and review the preparation and presentation of State's evidence in criminal and civil actions, and/or juvenile prosecution; counsel colleagues on legal strategies and legal issues; conduct preliminary evaluation of the case; review offer settlements. Personally direct and/or handle the investigation and prosecution of certain major criminal, key civil, or other high profile cases, to include legal arguments regarding merit; argue on behalf of the State against writs of habeas corpus, petition for post-conviction relief and motions to suppress evidence. Appear on behalf of the State in probation, revocation hearings and sanity hearings; prepare and supervise the preparation of legal briefs filed on behalf of the State. Present plea negotiations with opposing attorneys. Interview and advise complainants and witnesses in regard to prospective criminal or civil action. Confer with and advise County officials, employees, and representatives on legal questions; draft ordinances, resolutions and other legislative measures; represent the County in cases initiated by or against the County; confer with investigators regarding the collection of facts and evidence.

In this Senior Attorney position, draft, review, edit and advise on air quality rules and regulations, Notices of Violation, and settlement agreements. Represent DAQ in settlement negotiations, administrative hearings and legal proceedings.

In addition, maintain accurate records and files; prepare a variety of records and reports as assigned. Use standard office equipment, including a computer in the performance of the work. May drive a personal or County vehicle in the course of the work or be capable of arranging for transportation to off-site locations in order to attend meetings and conduct other legal business.

PHYSICAL DEMANDS

Mobility to work in a typical office setting and use standard office equipment, vision to read printed materials and a computer screen, and hearing and speech to communicate in person or over the telephone.
